Utility, Design, & Provisional Patents: Which Fits Your Invention?

Utility Patents

A utility patent protects how an invention works, including its function, process, or composition. It covers the operational aspects of a new product or process rather than its appearance. Utility patents last 20 years from the application filing date, subject to periodic maintenance fees.

Design Patents

A design patent protects only the ornamental appearance of an object, not its underlying function. If two products work identically but one has a distinctive visual design, a design patent covers that appearance. Design patents generally last 15 years from issuance and don’t require maintenance fees.

Provisional Patent Applications

A provisional patent application doesn’t result in an issued patent on its own, but it does something important: it establishes an early filing date. From there, an inventor has 12 months to file a non-provisional application while continuing to develop the invention. During that window, the invention can be marked “patent pending.”

Any U.S. patent requires showing the invention is new, useful, and non-obvious to someone with ordinary skill in the relevant field. Meeting those standards is where patent prosecution begins.

The USPTO Patent Application & Prosecution Process

Filing a patent application with the U.S. Patent and Trademark Office is the starting point, but the process extends well beyond that initial filing. An application must disclose enough about the invention to satisfy the USPTO’s novelty, utility, and non-obviousness requirements, and it must include claims that define the scope of protection sought.

After filing, the USPTO examines the application and may issue office actions raising objections or rejections. Patent prosecution is the back-and-forth process of responding to those office actions, arguing patentability, and amending claims when appropriate. That process can take one to three years or longer depending on the technology area and the complexity of the claims.

Once a patent is granted, the patent rights holder has the exclusive right to make, use, offer to sell, and sell the invention within the United States for the life of the patent. After the patent term ends, the invention enters the public domain.
